ACCEPTABLE USE POLICY

This Acceptable Use Policy applies to your use of anything that Machinations.io makes available, including (i) the http://machinations.io website (or successor website) (the “Website”); (ii) the my.machinations.io web application and the therein included, related, linked or otherwise connected thereto software, development kits, protection mechanisms, plugins, connectors, extensions, scripts, application program interfaces, software development kits, collaboration tools, all new releases, versions, modifications, updates, patches, improvements, enhancements, or similar derived works thereto, derived works of all the foregoing (the “Products”); (iii) the official guides for the Products, as made available here https://machinations.io/docs/ (or successor website) (“Documentation”); and (iv) any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links, created tasks and associated information, text, files and other content or materials (together, the “Content”) uploaded, downloaded, or appearing on or in our Website, Products or Documentation(the “Services Content”) (collectively, the “Services”).

This Policy outlines the standards of conduct we require on the Services and User Content and is designed to protect the integrity of the Services and others. “User Content” means any Content that including you provide, transmit, upload, publish or display through the Services.

This policy may change, so please check back regularly for updates and changes.

This Policy is read together with the Machinations Terms and Conditions available here https://machinations.io/terms-and-conditions/ and/or any other agreement (the “Agreement”) between Machinations.io (“we”, “our”, “us”) and the person using or otherwise accessing the Services (“you”).

WITHOUT LIMITATION, YOU AGREE, REPRESENT AND WARRANT TO NOT USE THE SERVICES IN ANY MANNER AND NOT PROVIDE, TRANSMIT, UPLOAD, PUBLISH OR DISPLAY ANY USER CONTENT THAT:

  • is illegal under or otherwise violates any applicable national or international law or regulation or would constitute, encourage or provide instructions for a criminal offense or any other illegal actions or omissions;

  • is accomplished through automated or non-human means, whether through a bot, script or otherwise, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools, or through creating user accounts by automated means or under false pretenses;

  • attempts to decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Service, to copy or adapt the software used in the provision of the Service, including but not limited to JavaScript, PHP, HTML, or other code, or to bypass any measures designed to prevent or restrict unauthorized access to the Services, or any part of the Services;

  • attempts to upload or to transmit viruses, Trojan horses, any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “PCMs”, or any other material that in any way interferes with our other users’ uninterrupted use of the Services or that modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services;

  • interferes with, disrupts, or creates an undue burden on the Service or the networks or services connected to the Services; systematically retrieves data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory, without written permission from us; has the purpose of collecting usernames and/or email addresses of users by electronic or other means for sending unsolicited email;

  • constitutes advertising or an offer to sell goods and services;

  • constitutes an attempt to impersonate another user or person or use the account of another user;

  • circumvents, disables, or otherwise interferes with security-related features of the Services, including features that prevent or restrict the use or copying of any Service Content or enforce limitations on the use of the Service and/or the Service Content contained therein;

  • constitutes an unauthorized framing of or linking to the Services;

  • tricks, defrauds, or misleads us or others;

  • violates the rights of any party (including without limitation intellectual property rights, rights of privacy and publicity);

  • infringes any copyright, patent, trademark, trade secret, or other proprietary or intellectual property rights of any person;

  • you do not have a right to distribute under the law or under contractual relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

  • otherwise breach the ToS, or in our sole judgment, may expose us or our other users to any harm or liability of any type;

  • other than for their intended and legal purposes.

IT IS YOUR RESPONSIBILITY TO ENSURE THAT YOU HAVE THE APPROPRIATE PERMISSIONS TO UPLOAD YOUR USER CONTENT TO THE SERVICES AND, BY TRANSMITTING, UPLOADING, PUBLISHING OR DISPLAYING ANY USER CONTENT, YOU REPRESENT AND WARRANT THAT:

  • the distribution and the access or download of your User Content do not and will not infringe any proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third-party or any rights of privacy and publicity;

  • you are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to enable us and our other users to access your User Content as authorized by you;

  • your User Content does not constitute unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation or offers;

  • your User Content does not include anything may be obscene, violent, harassing, libelous, slanderous, or otherwise objectionable, or that may violate any applicable law, regulation, or rule.

You agree that you will not copy, reproduce, republish, frame, download, transmit, modify, display, reverse engineer, sell, or participate in any sale of, rent, lease, loan, assign, distribute, license, sublicense, or exploit in any way, in whole or in part, the Services or any related software, except as expressly stated in the Agreement.

You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Services.


We may provide within the Services certain areas for comments or interaction with other users of the Services. When posting a comment, or when interacting with another user of the Service, you must comply with the following criteria:

  • the comment / interaction should not contain profanity or abusive, racist, offensive, or hate language;

  • the comment / interaction should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;

  • the comment / interaction should not contain references to illegal activity;

  • the comment / interaction may not contain any false or misleading statements; and

  • you may not organize or participate in campaigns encouraging others to post comments or initiate interactions, whether positive or negative.

We may accept, reject, or remove comments / interactions in our sole discretion. Comments / interactions are not endorsed by us, and do not represent our opinions or the views of any of our affiliates or partners. By posting a comment / initiating an interaction, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to such comment / interaction.

INTELLECTUAL PROPERTY RIGHTS NOTICE AND TAKE-DOWN

The Services cannot be used by you in a manner that infringes any intellectual property rights. If you have reasons to believe that any content, material or information may infringe your intellectual property rights or those of any third-party you shall submit a notice in this respect at contact@machinations.io. We will respond to any sufficiently substantiated notice submitted in accordance with this provision. A notice shall be deemed sufficiently substantiated if it includes the following:

  • your address, email address and telephone number;

  • relevant and accurate information, including a thorough description of the work that you claim is being infringed, along with information about where it is located;

  • an electronic or physical signature of the rightholder (or a person authorized to act for the rightholder);

We will respond to any notices submitted in accordance with this provision without undue delay and when the notice is substantiated, we will remove the Content from the Website.

If the substantiated notice refers to the Services Content or the Services you understand that their further use and sharing, regardless of the medium, may amount to a subsequent infringement of the intellectual property rights claimed under the notice. Any such further use and sharing by you of any infringing Content or Services will be at your own risk and we shall not be liable for any damages caused by such use.
